TERMS AND CONDITIONS

This describes the Terms and Conditions applicable to your use of the Ascribe (“Company”) Vendor Portal, and to the association between the Company and you, the user, a state-licensed real estate appraiser, real property inspector, real estate agent or salesperson, or real estate broker.

 

By agreeing to these Terms and Conditions, you:

 

  • Confirm you have received and agree to the terms outlined in the Vendor Engagement Agreement, Vendor Code of Conduct, and Vendor Performance Expectations, regardless of if you have acknowledged or signed such documents formally
  • Understand it is your responsibility to obtain, understand, and follow the conditions outlined within the above referenced documents
  • Confirm you have NOT pled guilty or nolo contendere, have not been convicted, and/or have not been involved in any crime involving dishonesty, fraud, theft, public trust, breach of trust, or money laundering, or any other crime that would suspend or terminate licensure or certification
  • Agree to perform all services in compliance with all federal, state, local, and industry professional guidelines, standards, laws, ordinances, and regulations applicable to the specific service, now or hereafter in effect, including but not limited to the Fair Housing Act, the Equal Credit Opportunity Act, all other federal anti-discrimination laws, CCPA, GLBA, GDPR, USPAP, and IAG
  • Will not engage in appraisal bias, or other valuation bias or discrimination
  • Will immediately notify the Company of any claim or concern by any party that services rendered for the Company have potentially violated fair housing or anti-discrimination statutes
  • Will fully cooperate with investigations on claims of bias as it relates to the services performed
  • Agree to personally complete all assignments in their entirety, up to and including the physical inspection of the subject property; vendors will not subcontract or reassign any assignment, or part of an assignment, to any other party, per the Order Acceptance section of the Vendor Performance Expectations
  • Will keep confidential and not copy, reproduce, sell, assign, license, market, transfer or otherwise dispose of, give, or disclose to any third party any confidential Client or Company information
  • Will take all reasonable measures (including without limitation such measures taken to safeguard vendor’s own Confidential Information) to ensure the security and confidentiality of all Confidential Information, to protect against anticipated threats or hazards to the security or integrity of such Confidential Information, and to protect against unauthorized access to or use of such Confidential Information.
  • Will promptly inform the Company in the event of any actual or suspected security breach
  • Understand that you are working as an independent contractor under Federal, State, and local laws and regulations, and that you are not restricted in any way from contracting with additional clients, as described in the Vendor Engagement Agreement unless you have an active employment agreement stating otherwise
  • Will act in accordance with the Vendor Code of Conduct, reflecting client and industry expectations
  • Acknowledge that Ascribe does not approve the use of auto acceptance tools that interact with our portal and understand that termination of your vendor account will occur if such actions are confirmed
  • Will act in accordance with the Vendor Performance Expectations, reflecting client and industry standards
  • Certify that you are currently in good standing with each regulatory body as of the date of your acceptance of these Terms and Conditions
  • Agree to report to the Company any revocation, cancellation, non-renewal, voluntary forfeiture, suspension, fine, reprimand, lawsuit against, open or pending complaints or disciplinary actions, probationary or similar status, or other similar actions related to licenses that limit or reflect on the ability to perform services
  • Agree to disclose to the Company if you are added to any exclusionary list upon notification by lender, company, agency, or organization
  • Will notify the Company upon discovery of any adverse event, action, complaint, or potential complaint regarding the service provided to the Company, regardless of the entity that is the subject of the complaint
  • Confirm your acceptance of assignment of your Vendor Engagement Agreement, Vendor Code of Conduct, and Vendor Performance Expectations to the Company and/or its successors and assigns

 

The Company may amend these Terms and Conditions at any time. All amended terms shall be immediately effective. If you do not agree to be bound by these Terms and Conditions, do not access the Company’s Vendor Portal, or accept service requests from the Company.
